The mortgage on land use has long been no longer a new issue in the law as well as in practice. With the increasing popularity of secured transactions, especially the mortgage transaction, the Vietnamese law also has a positive interest in improving the regulations around the issue. However, because land use rights are a complex factor, which is governed by a variety of specialized laws, it is in fact a situation where the regulations overlap with each other when resolving the same problem or vice versa , there is no applicable regulation to resolve it. The research papers are directed to a single subject in the implementation of the mortgage on land use, households, performing the analysis of the risks that households may encounter from the inconsistency of current legislation , to propose some corrective solutions in order to protect the rights of individuals in the household when they exercise their rights.
